The company issued a statement through a spokesman saying that the case had no merit, and would fight it vigorously.

Facebook's facial recognition technology, which it uses to recognise users in photos and identify impersonators, has not been available in the European Union since 2012 after being accused of violating privacy laws for not obtaining users' consent. The lawsuit says this breaches IL state law. But the lawsuit alleges the feature violates Illinois' Biometric Information Privacy Act, a 2008 law that prohibits companies from collecting and storing the biometric data of people without their consent.

In a successful class action suit, any person in that group could be entitled to compensation.

As part of initial legal procedure, the class of people filing this lawsuit has been legally defined as Facebook users "in IL for whom Facebook created and stored a face template after June 7, 2011".

Cobbe said she believes Facebook's implementation will fall afoul of GDPR, because it will have to scan every face in photos just to see if the photo subjects have consented to use of the tech.

In December 2017 Facebook announced that users would be notified if a picture of them was uploaded by someone else, even if they hadn't been tagged in it.
