The bench, the members of which will be known soon, will consider if the mandatory nature of the scheme is an infringement on a citizen's right to privacy.

GOVERNORNew Delhi, July 11The AAP government today requested Chief Justice of India (CJI) JS Khehar to set up a constitution bench to decide the dispute between the Delhi Government and the Lieutenant Governor over their powers and jurisdiction.

The SC said the Constitution Bench will sit on July 18 and 19 to hear matters related to Aadhaar.

On June 10, the Supreme Court had ruled that from July 1 onward, every person eligible to obtain Aadhaar card must quote their Aadhaar number or their Aadhaar Enrolment ID number for filing of Income Tax Returns as well as for applications for Permanent Account Number (PAN).

Two main grievances with the Aadhaar Act include the Centre's move to make it mandatory for social schemes and the aspect of right to privacy. The petitioners had alleged that collection of personal details like finger prints and iris scan violated the right to privacy. The petitioners contended that it amounted to violation of the provisions under right to privacy. Hence a five judge bench can not hear the matter, he also said.

Hence, Mr. Venugopal suggested that it has to be first decided whether the petitions should be referred to a Bench of nine judges for hearing and decision.

The setting of the Constitution bench was pending since 2015. It said about 115 crore people had already been issued Aadhaar card and by this method lakhs of fake ration cardholders had been eliminated and Rs. 56,000 crore had been saved.
