Jury selection complete for Cosby sexual assault trial

Defense raises race bias in Cosby jury selection process 11 people seated on Cosby jury; defense sees race bias

A jury of seven men, five women and six alternates from Allegheny County are ready to hear Bill Cosby's sex assault case in Montgomery County Court on June 5th.

Eleven jurors have been picked thus far for the Bill Cosby trial after the second day of jury selection at the Allegheny County Courthouse in Pennsylvania.

In the end two black jurors were selected: a woman who said she knew little about the case and a soft-spoken, extremely polite man who left the courtroom before his selection was announced by cheerily saying, "Have a good day" to the judge.

Last week, Cosby said race could be a motivating factor in the dozens of sexual assault allegations lodged against him.

After prosecutors struck two black women from the panel, defense lawyer Brian McMonagle attacked what he called the other side's "systemic exclusion of African-Americans". Afterward, Constand filed a civil lawsuit, which was settled in 2006.

Cosby, who has been charged with aggravated indecent assault, is accused of drugging and molesting former Temple University employee Andrea Constand at his Cheltenham home in 2004. Others were sent home after being questioned individually about various problems or conflicts.

Loyola Law School professor Laurie Levenson wonders if Cosby is trying to signal to blacks on the jury with his recent comments, by sending the message "that you have a mission on this jury, to make sure he's not treated as a black man who's come on aggressively to white women". The percentage of African Americans in the final composition of the jury actually slightly exceeds that of Allegheny County, where the pool was drawn - 16 percent of the jury is black while the county is 13 percent black.

The Associated Press doesn't typically identify people who say they are the victims of sexual assault unless they come forward, as Constand has done.

Cosby, whose reputation as America's favorite TV dad has been irreparably sullied, has denied any wrongdoing and said every sexual encounter was consensual.

Cosby disclosed in a SiriusXM radio interview [May16] that he would not testify in his defense.

McMonagle challenged the prosecution's move, arguing that it was a violation of U.S. Supreme Court ruling Batson vs. Kentucky, which states prosecutors must find a race-neutral reason for keeping minorities off juries with a preemptive strike. They will be sequestered 300 miles from home in suburban Philadelphia for the trial.

A jury has been seated in the trial of comedian Bill Cosby.

"Could be, could be", Cosby responded when Smerconish asked him if he thought racism played a role in his trial.

The jury was was selected from the Pittsburgh area.

The trial will begin on June 5 in Montgomery County, as the defense unsuccessfully petitioned for it to take place elsewhere. Cosby in sworn testimony has said he put his hand down Constand's trousers, but said she did not protest.

Cosby has pleaded not guilty to all charges.

Prosecutors declined to bring charges against Cosby in 2005, although he was later arrested on December 30, 2015, just days before the 12-year statute of limitations expired.
