Gov't Wants More Time To Address Second Travel Ban Ruling

Another US appeals court keeps US President Donald Trump's travel ban blocked The Latest: White House says travel ban is 'fully lawful'

The court is now considering an emergency request from the administration seeking to put its travel ban into effect while litigation continues.

The Council on American-Islamic Relations (CAIR), the nation's largest Muslim civil rights and advocacy organization, Monday welcomed a unanimous ruling by the three-judge 9th U.S. Circuit Court of Appeals upholding an earlier decision by a federal judge in Hawaii to block President Donald Trump's revised "Muslim ban" executive order.

President Donald Trump once told opponents of his travel ban that he'd see them in court, and he's doing everything he can to keep that promise.

Given the high court's looming summer recess-the spring term ends on June 26-the schedule is tight for everyone and tensions may run high this month even for the usually cool justices. The Hawaii judge also blocked a 120-day ban on refugees entering the United States.

The 4th U.S. Circuit also has called Trump's national security concerns an after-the-fact justification for a policy that was "rooted in religious animus".

One of the nominees, according to The Washington Times, Colorado Supreme Court Justice Allison H Eid, is being earmarked by the President to fill a vacancy on the 10th US Circuit Court of Appeals which opened up when Justice Neil Gorsuch was confirmed for the Supreme Court in April. "As the government says, there is no doubt that this executive order 'has been the subject of passionate political debate.' But whatever one's views, 'the precedent set by this case for the judiciary's proper role in reviewing the president's national security and immigration authority will transcend this debate, this order, and this constitutional moment'". Both are at stake in the Hawaii case; the Maryland case involves only the 90-day suspension of arrivals from the designated nations.

The Supreme Court could discuss how to act on the emergency application at its private conference on June 22, a week after the Gorsuch ceremony. The high court seat was vacant for almost 14 months after Senate Republicans refused to take up President Barack Obama's nomination of Judge Merrick Garland.

A memo issued by the White House, as the Supreme Court considered two challenges to the ban, said parts of the order put on hold would not expire before they can go into effect, and the start date would be when court injunctions were lifted.
